1. You are the sole; absolute and lawful owner of the Product and you declare under these terms and conditions that the laptop was solely for personal use and not for business or commercial use.
2. For the purpose of these terms of use, wherever the context so require 'You' shall mean any natural or legal person who has agreed to become a member of the Website by providing Registration Data while registering on the Website as Registered User using the computer systems of …………….
3. Service available through or use of the Website is available only to persons of majority (18 years of age or more) and who can legally component to form a contract under the Indian Contract Act, 1872 (as amended from time to time), or any other act or enactments to which the person is subject. Persons who are incompetent, to make a legal and valid contract, for any reason whatsoever (minor, lunatic, insane, undischarged insolvent or otherwise) are not eligible to use Our Website and avail Our Services. 4. The Used Product along with all accessories, wherever applicable, which is being sold by a seller and being purchased by QUIKSELL is genuine and is not counterfeit, free from any and all encumbrances, liens, attachments, disputes, legal flaws, exchange or any agreement of sale etc.
5. Where applicable, the Used Product's details, including its condition, are as stated when the Offer was accepted. If the Used Product is a television (TV), laptop, mobile device, or tablet, for example, it must be in operational order and have an intact display or screen, meaning it should not have any cracks, scratches, discoloration, spots, lines, dead pixels, or other types of damage. Any tempered glass, screen guards, scratches, or other protective coverings that have been put to the Used Product device's screen must be removed. All personal information must be erased, Google (Android) and iCloud (iOS) accounts must be closed, lock codes and passwords removed, and the battery of the suggested exchange phone, laptop, or tablet must not be lifeless or inoperable. Stated otherwise, the gadget ought to function and switch on even when the charger is not connected.
6. You also affirm that: all data in the Used Product (if any and wherever applicable) will be deleted before being exchanged under the Offer; even after manually or electronically erasing the data, if any data remains accessible for any reason, QUIKSELL or its affiliates, the seller, the partner, the future buyer, or the manufacturer shall not be liable for the same and you will not contact any of the aforementioned parties for any data retrieval or deletion; and the applicable Used Product should already be kept uninstalled at the time of delivery of the new product.
7. You consent to indemnify and keep indemnified QUIKSELL and its affiliates, the relevant seller, the buyback partner, and any subsequent buyers of the Used Product against all claimsagainst any and all demands, costs, expenditures, and legal fees made by third parties against QUIKSELL, its affiliates, the relevant seller, the buyback partner, or any subsequent buyer as a result of usage of the Used Product by you; any available data about the Used Product; return of a different product, if the Used Product does not match the requirements outlined below, or if the Used Product's condition differs from what was stated when the Offer was taken advantage of; and any violation of these terms and conditions governing the Offer and any breach of these Terms and Conditions.
8. By allowing this transaction, you agree that the purchaser, the buyback partner, and other organizations engaged in the management and administration of the Offer may handle, transfer, and keep the personal information you have submitted in connection with it.
9. Please make sure the delivery associate is not left alone when the used product is being uninstalled. If there is a disagreement or problem with the delivery partner or the uninstallation: If there is a disagreement or problem with the delivery associate or the uninstallation, QUIKSELL will not be held accountable or liable for the aforementioned disagreement.
10. You acknowledge that there will be no circumstances under which the Used Product can be returned to you once the purchase has been completed by QUIKSELL and the You (seller)have delivered the Product to QUIKSELL. The transaction between You and QUIKSELL is absolute and under no circumstances will QUIKSELL return the purchased used product to You.
11. You consent to waiving any claims you may have about the appropriateness of the value (if any) of the Used Product supplied as part of the Offer against QUIKSELL and its affiliates, the relevant seller, the buyback partner, and any subsequent buyer of the Used Product. You agree not to take advantage of the Offer if you disagree with the value that has been offered to you for the Used Product.
